Mediation and Arbitration Rates
Mediation Rate Options and Information
- Services may be retained either on a “daily” rate or "half day" basis. These mediation rates vary depending upon the county in which the mediation is to be conducted. Please call for the applicable rates at: (877) AMC-4ADR / (877) 262-4237.
- The "daily" mediation rate entitles the parties to the time Mr. Ashley spends preparing for the mediation or arbitration and up to 12 hours of his time on the day of the mediation.
- The "half day" mediation rate covers
Mr. Ashley's "prep
time" and 5 hours of work on the day of the mediation. The attorneys
continue to be charged at the applicable hourly rate for all hours
worked beyond the fifth hour on the day of the mediation. The "daily" mediation
rate cap does not apply if the "half day" mediation rate
is selected. Note:
It is frequently more economical to retain Mr. Ashley on a "daily" rate
basis.
In addition, Mr. Ashley is free to accept other engagements following the scheduled end of a "half day" mediation. - The attorneys are also charged an administrative fee of $150 per party (or separately represented group of parties) to cover the costs of setting up the file and administering the case.
- Fees are the responsibility of the participating attorneys and are split between them in the manner they designate.
- The attorneys are required to advance the full amount due under the rate option selected no later than 14 days prior to the scheduled mediation. The attorneys will be invoiced If additional amounts become due.
No Other Charges
- No charge for travel to mediations conducted in the counties of Orange, Los Angeles, San Diego, Riverside and San Bernardino.
- No charge for use of neutral facilities in San Diego, Los Angeles, Orange County and the Inland Empire.
Mediation Time Scheduling
- Mediations reserved on a "half day" basis are scheduled to commence no later than 9:30 a.m. on the day of the mediation.
- As noted above, where Mr. Ashley's services are retained on a "half day" basis, he may accept other engagements following the scheduled conclusion of the mediation. To assure Mr. Ashley's availability throughout the day, his services should be retained on a "daily" rate basis.
Mediation Retainer Policy
- Dates tentatively reserved are not deemed confirmed prior to receipt of payment in full for services.
- Tentative reservations shall be lost if payment in full is not received at least 14 days prior to the mediation date requested.
Cancellation - Continuance Policy
- There is no charge (beyond the administrative fee) for a cancellation or continuance of a mediation that occurs 15 days or more in advance of the scheduled date of the mediation.
- The attorneys will be charged the full amount of Mr. Ashley's fee in the event they cancel or continue the mediation within 14 days of its scheduled date unless he is able to book another matter for that date.
The foregoing information does not apply to mediations Mr. Ashley conducts as a member of a court mediation/settlement officer panel.
